Non exhaustive TOS By registering with 4M, (The Company), you (The User) agrees to comply in full with the Terms and Conditions (TOS) as defined hereunder and that you will not, under any circumstances, violate or otherwise misuse the TOS without prior notification to IsMyFamily.
The TOS is set out to make your experience with ismyfamily as comfortable and professional as possible while creating a safe work environment for all Users to this service.
You also agree that to violate this TOS as stated hereunder; will result in suspending or terminating your account and without any notice of such action.
SPAMMING Spamming is totally and completely prohibited on any web site or any communication means provided by The Company and will not be tolerated under any circumstances. This includes, but is not limited to: * Sending of unsolicited messages in bulk, or the sending of unsolicited e-mails, which provoke complaints from recipients
* Sending of email or Private Messages in bulk for the purpose of gain
* The sending of junk mail
* The use of distribution lists that include people who have not given specific permission to be included in such a distribution process
* Posting commercial ads to newsgroups that do not permit it
* Posting in bulk on Message Boards for the purpose of financial gain
* Posting articles containing binary encoded data to non-binary newsgroups
* Excessive and repeated posting of off-topic messages to newsgroups
* Excessive and repeated cross-posting
* E-mail harassment of another Internet Customer or Customers, including but not limited to, transmitting any threatening, libelous or obscene material, or material of any nature which could be deemed to be offensive
* The e-mailing of age-inappropriate communications or content to anyone under the age of 18
* "Spamming" is considered as explicit misuse of ethical principles and will be interpreted as a violation of them
* The maximum number of allowed e-mail messages sent per day is 500. There are no exceptions to this rule.
Any account found to have been used for such activity will be immediately suspended. CONTENT
The Company has a zero tolerance policy on illegal activity and content on any web site or message board hosted by The Company. The following content is strictly NOT allowed on your website: * Adult Illegal Pornography Nudity or Pornographic Site(s)
* Child Pornography - Sexually Suggestive Depiction of Children
* Copyright - Infringement of Copyright
* Cracking - Brute Force Access of Secured Network Devices
* Defamatory or Violates a Person's Privacy
* DoS - Denial of Service Attack
* Forging - Faking an IP Address, Hostname, E-Mail Address, or Header
* Fraud Site - Hosting a Website Intended to Deceive the Public
* Gambling Casino, Gambling Activity of Any Kind
* Hacking - Circumventing Security Systems of Network Devices
* Hosting - Starting Your Own Free Host, File Host or Image Host
* IRC Client, IRC Server, IRC BotNet, IRC Eggdrop
* Links - Links to External Websites Must be Suitable
* No. Of Accounts - Only 1 Account Per Person
* Language - Subdomains: Must be English unless authorised. Domains: Can be Non-English
* Phishing - Identity Theft by Email under False Pretense
* Profanity - No Abusive, vulgar, or irreverent language
* Redirecting - Automatically Redirecting your website to any other website
* Proxy - PHP Proxy, CGI Proxy
* Sales or promotion of certain weapons, such as firearms, ammunition, knives, and brass knuckles
* Sales or promotion of beer or hard alcohol, tobacco or tobacco-related products and drugs
* Scanning - Probing for Vulnerabilities of Network Devices
* Spamming - Unsolicited Commercial Email or Unsolicited Bulk Email
* Spam Site - Hosting a Site Advertised via Spam
* Virus, Worm, Trojan, Spyware, Adware
* Violent, Incites Violence, Threatens Violence, or Contains Harassing Content or Hate Speech
Any accounts found to be used for the purpose of promoting, condoning, containing or linking to such content as Hacks, Cracks, Warez, Pornography or copyrighted materials will be terminated without any prior notice from The Company. LANGUAGE Subdomains: All content on all subdomains must be in ENGLISH ONLY.
All other languages are forbidden by The Company, unless special permission is accepted. Domains: All content on TLD domains is allowed to be non-english, providing an english translation is available. FILE TYPES
Filetypes Allowed: HTM, HTML, XHTML, SHTML, XML, CSS, TXT, DOC, PDF, PHP, PHP4/5, CGI, JS, SQL, CFG, PL, PY, PYO, PYC, JPG, GIF, ZIP, RAR, TAR.GZ
Filetypes Strictly Against TOS: Any other file not in the allowed filetypes. .EXE is strictly NOT ALLOWED. Certain filetypes are not allowed for security reasons. SUSPENDED ACCOUNTS
Accounts suspended by a member of Staff will remain suspended for a maximum period of 10 days only.
Accounts suspended for a period exceeding the specified 10 days period will be terminated. No data will be recovered after termination of accounts. INACTIVE ACCOUNTS
Accounts with no content on will be suspended after 7 days. You must upload files to your website within 7 days.
Accounts which have used no bandwidth at the end of the month, may be suspended. You must have used some bandwidth on your website at the end of the month. They will then be terminated as per the 10 day rule BACKUPS
ismyfamily will never perform back-ups of data on users website's. The User is responsible for independent backup of data and that Provider shall have no liability to customer in the event all data is lost or destroyed.
The User acknowledges and agrees that in the event restoration of data from backup is necessary, it may take a reasonable time to complete such restoration of data and resume operation of the service. EXCEEDING BANDWIDTH/SPACE LIMIT
You are limited on how much bandwidth and space you are allowed.
If your bandwidth limit is exceeded, your account will be (automatically) suspended until the next month, when it will be unsuspended when your bandwidth has reset.
If your space limit is exceeded, you will be warned by email. If after 72 hours your space usage is exceeded, you will be suspended. CUSTOMER ABUSE
Any case of any indecent treatment towards ismyfamily will be considered inappropriate. Each Customer is anticipated to conduct a professionally mannered communication with ismyfamily regarding any requests for help through e-mail.
Each Customer should avoid applying any forms of written emotional outburst or cursing. Any attempts of deliberately undermining behavior will be interpreted as a breach of this TOS.
Other acts of treatment towards ismyfamily that will be considered as unacceptable include any verbal, oral, written or delivered by a second party threats addressing ismyfamily or any of its employees, partners, equipment, and concerns.
Any forms of such threats will be interpreted as a breach of this TOS. ismyfamily keeps the right to assess which behaviour will be treated as a breach of this TOS and users will be suspended for violating the aforementioned rules. PRIVACY POLICY
The Company understands everyone’s right to privacy, which is why we have created this simply policy in accordance with your right to privacy.
Cookies: Cookies are generated and stored on your computer’s hard drive to store information and preferences to make your use of our services easier on you. Information such as Passwords are recorded by these Cookies. However, such information is not available to any other person only the specific user of that computer.
Storing of Information: Certain information can be stored in our databases when you access any web site or message forum provided by or hosted by The Company. This information includes your IP Number (The number provided by your Internet Service Provider (ISP), which is the address to your computer. This information is only visible to the Staff of The Company and by the Administrative Staff of message boards that you use. This information is kept private from public view and will not be sold or forwarded to any third party for promotional or any other means.
Such information can, however, be used to report any violations of The Company’s Terms of Service. OUR RIGHTS
The Management and Staff of The Company, reserve the right to: * Refuse services to any individual or group in its sole discretion and will take every step necessary to ensure current and forthcoming clients that the services are provided on an equal scale and without prejudice.
* Suspend any website that is in violation of the Terms of Service.
* Perform regular checkups on your website. These Terms Are Subject To Change Without Notice.
